' Board of Appeals John C. & Joann T. Wcjciechowicz SP -99-26 <br />FINDINGS <br />General Findings <br />1. the subject property is located at 67 Great Pines Drive and consists of 13,435 <br />square feet. <br />Special Permit Criteria I . <br />Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br />Law Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br />shall not be substantially more detrimental to the neighborhood than the existing <br />non -conforming use. <br />Specific Findings <br />1. the proposed addition conforms to the setback requirements from the street, <br />but does not conform to the sideline setback requirements and the Board has <br />granted a Variance of 10.4 feet. <br />2. the changes between the proposed addition and the prior one will result in an <br />increase of only 2.1 % and is under the allowed limit for lot coverage. <br />3. while the proposed addition will increase the non -conforming nature of the <br />structure, the changes will not result in a structure or use which is more <br />detrimental to the neighborhood than the prior non -conforming structure and <br />its use. <br />4. the immediate neighborhood consists of single-family homes of similar size. <br />Many have been improved with additions or reconstruction. <br />5. the addition will be an improvement to the home. <br />6. the installation of a new Title V Septic System will be an improvement to the <br />property and benefit the neighborhood. <br />In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br />met the criteria necessary for the granting of a Special Permit. Upon motion duly made <br />and seconded, the Board of Appeals voted unanimously on June 9, 1999 to grant a <br />Special Permit. The permit is conditioned upon compliance with the following: <br />1. plans of I. T. Almy Associates/Architect, Addition to Residence, Mr. & Mrs. <br />John Wcjciechowicz, 67 Great Pine Road, Mashpee, MA., Dated Nov. 1998. <br />2. plans of Cape & Islands Engineering, Plot Plan of Land Located in Mashpee <br />— Mass. Prepared for John Wojciechowicz, Dated Nov. 30, 1998, Plan <br />No. 113098. <br />3. the applicants must install a new Title V Septic System. <br />
