MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> FEBRUARY 9,2022 <br /> Mr.Furbush read an email from Chris Gallagher submitted at 2:49 pm on February 8,2022. <br /> "Based on the definition of a half-story,the square feet of a half-story can be no more than <br /> two-thirds of the floor below it...etc. He said that it looks like this may need two-thirds <br /> although the square footage isn't listed. It does not meet the vertical wall being stepped <br /> back 2 ft. from the floor below it. Therefore,the proposed house does not meet the criteria <br /> of a half-story for its top floor, and by definition is a story." <br /> Chris said there are a lot of homes in Town that would be non-compliant. He read the article <br /> when it went to Town Meeting,but he thinks the intent was the interior wall because if the <br /> interior square footage is two-thirds,then the interior wall is two-thirds. It would not make <br /> sense because every gable end on a house would have to be stepped in. <br /> Mr. Blaisdell believe that the intent of the bylaw is to make sure that the wall doesn't <br /> exceed two-thirds of the floor below it. He believes that this house does not exceed that at <br /> 55%. He believes it could go has high as 66.6%. He said this meets the intent of the bylaw. <br /> Mr. Furbush polled the other Board members; Mr. Gould had no comments. Mr. Pittsley, <br /> no comments, Mr. Ganzenmuller,no comments. <br /> Mr. Reidy commented that it either meets the two-thirds or it does not. In his opinion, it <br /> would be in the mind of the person who wrote the bylaw. He is not bothered by the <br /> appearance of what was presented. <br /> Ms. Sangeleer wanted an understanding of the gable and dormers of a house. <br /> Mr. Gallagher said that he measured the house, and said that the height is at 34 ft. <br /> Dave will require an engineer to submit documentation on the height prior to approval of <br /> the frame inspection. <br /> Ms. Sangeleer read the Board of Health and Conservation Department comments into the <br /> record. <br /> Ms. Ellen Hudon an abutter read her letter of opposition into the record. <br /> Mr. Furbush explained that 30 Sand Dollar Lane is not within the New Seabury Special <br /> Permit area. The Zoning Board is responsible to enforce the bylaws for any building on <br /> properties. Properties under the New Seabury SP do not go to the Zoning Board. <br /> 4 <br />
