Mr. Charles <br /> Alexander commented at the meeting that he also approves the project. No other <br /> comments were received from abutters. <br /> FINDINGS <br /> General Finding <br /> 1. the subject property is located at 375 Nathan Ellis Highway and consists of <br /> 34,545 square feet. <br /> Special Permit Criteria <br /> Section 9 of Chapter 40A and Section 174-24C of the Mashpee Zoning By-laws <br /> require that the permit granting authority determine that the proposed use and <br /> development are consistent with applicable law, rules and regulations; that there will be <br /> no adverse effect on public health or safety; that there will not be an excessive demand <br /> upon community facilities created as a result of the proposal; and that there will not be a <br /> significant adverse impact on the environmental factors listed in Section 174-24.C.2. <br /> Specific Findings <br /> 1. there is adequate land area to provide sufficient parking. <br /> 2. the immediate neighborhood consists of commercial businesses. <br /> 3. due to the unusual shape of the lot,there is no other location for the proposed <br /> building. <br /> 4. the Department of Environmental Protection has confirmed that an auto repair <br /> facility is an allowed use within this zone. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Special Permit. Upon motion duly made <br /> and seconded, the Board of Appeals voted unanimously on June 9, 1999 to grant the <br /> Special Permit. The permit is conditioned upon compliance with Cape & Islands <br /> Engineering plan, Plan No. 031599, Date: Mar. 15, 1999, Revised 4/22/99 and 5/19/99. <br />
