Town of Mashpee <br />16 Great JVeck Poad JVorth <br />Mashpee, Massachusetts 02649 <br />1301 11CSIVAUUMM �9 <br />Decision for a Special Permit <br />RE: Mashpee Commons Limited Partnership SP -99-49 38 Nathan Ellis Highway <br />Map 74 Block 20 <br />A Petition was filed on May 14, 1999 by Mashpee Commons Limited <br />Partnership of Mashpee, Massachusetts for a minor revision of existing Special <br />Permits (SP -86-04-024 and SP -99-14) for permission to relocate building space <br />square footage on property located in a C-1 zoning district at 38 Nathan Ellis Highway <br />(Map 74 Block 20), Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on May 21 and May 28, 1999, <br />a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, June 9, 1999 at which time the following members of the Board of Appeals <br />were present and acting throughout: James E. Regan III, Robert G. Nelson and James M. <br />Dorgan. <br />This Decision is issued by the Mashpee Board of Appeals pursuant to the <br />provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br />Mashpee Zoning By-laws. <br />Mr. John Renz, Vice President Mashpee Commons, L.P., and Randall Imai of <br />Imai/Keller, Inc. Architects attended the meeting. Mr. Renz stated that the proposal is a <br />minor revision of Special Permit SP -86-04-024, granted in 1986 by the Board of Appeals. <br />He also stated that the 1986 Special Permit conditions Nos. I and 5 provide for alteration <br />of square footage with Board of Appeals' approval. <br />Mr. Renz submitted an updated table documenting the minor revisions to Building <br />15, listing buildings by number, square footage and residential units assigned to each <br />building, and a map of Mashpee Commons documenting the square footage, copies of <br />which are attached and made part hereof the Special Permit. He stated that what the <br />applicant is doing is formalizing the specific approval for both Building 15 and Building <br />24 now that the tenancy has been identified and the building program for each building <br />has been finalized. <br />
