McCormack V-99-46 77 Tide Run <br />Map 120 Block 190 <br />A Petition was filed on May 6, 1999 by William M. and Geraldine H. <br />McCormack of Naples, Florida for a Variance from Sections 174-31, 174-33 <br />and 174-85 of the Zoning By-laws for permission to vary the following: the sideline <br />and rear setback requirements, the setback requirements from the wetlands and the <br />setback requirements from the ACEC to allow for additions to property located in <br />an R-3 zoning district at 77 Tide Run (Map 120 Block 190) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on June 4 and June 11, 1999, <br />a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, June 23, 1999, at which time the following members of the Board of <br />Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br />and Robert G. Nelson. <br />This Decision is issued by the Mashpee Board of Appeals pursuant to the <br />provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town <br />of Mashpee Zoning By-laws. <br />Mr. Michael Grotzke of the Phoenix Group represented the applicants. The <br />applicant is scheduled to appear before the Conservation Commission on July 1, 1999. <br />Mr. Govoni stated that the Board of Appeals needs Conservation Commission approval <br />prior to granting a Variance. <br />The Board voted to continue the hearing until July 14, 1999 to allow the applicant <br />the opportunity to receive approval from the Conservation Commission. <br />At the Public Hearing on Wednesday, July 14, 1999, Mr. Chris King from the <br />Phoenix Group represented the applicants. The Conservation Commission submitted a <br />letter indicating approval of the project. <br />No comments were received from abutters. <br />
