Thomas Ferrante SP -99-51 <br />Board of Appeals <br />FINDINGS <br />General Findings <br />1. the subject property is located at 71 Timberlane Drive and consists of <br />14,690 square feet. <br />Special Permit Criteria <br />Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br />Law Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br />shall not be substantially more detrimental to the neighborhood than the existing <br />non -conforming use. <br />Specific Findings <br />1. that the proposed construction conforms to setback requirements, except for <br />the setback requirement from the water and wetlands. The Board has granted <br />a Variance of 17.3 feet from the top of the bank to the wetlands. <br />2. that the Conservation Commission and the Board of Health have approved the <br />project. <br />3. that the installation of a new denitrification system will be an improvement to <br />the property. <br />In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br />met the criteria necessary for the granting of a Special Permit. Upon motion duly made <br />and seconded, the Board of Appeals voted unanimously on September 8, 1999 to grant a <br />Special Permit to demolish the existing structure and construct a three-bedroom home. <br />The permit is conditioned upon compliance with plan entitled "Proposed 3 Bedroom <br />Dwelling, 71 Timberlane Drive, Mashpee, MA., C. Thomas & Iva Ferrante, 29 Edgehill <br />Road, Arlington, MA., Pesce Engineering & Associates., SCALE: 1" = 20', DATE: <br />3-29-99, REV: 7-16-99 and 8-26-99, JOB NO. 51631". <br />
