I� <br />`town of Mashpee <br />16 Great JVeck load JVorth <br />Mashpee, Massachusetts 02649 <br />BOARD OF APPEALS <br />Decision for a Special Permit <br />David M. & Karen Lupo SP -99-45 <br />65 River Road <br />Map 89 Block 3F <br />A Petition was filed on May 6, 1999 by David M. and Karen Lupo of Mashpee, <br />Massachusetts for a Special Permit under Section 174-25.I.9 of the Zoning By-laws for <br />permission to construct a pier, ramp and float in Mashpee River on property located in an <br />R-5 zoning district at 65 River Road (Map 89 Block 317) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on June 4 and June 11, 1999, a <br />copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, June 23, 1999, at which time the following members of the Board of <br />Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br />Robert G. Nelson. <br />This Decision is issued by the Mashpee Board of Appeals pursuant to the <br />provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br />Mashpee Zoning By-laws. <br />Mr. Michael Grotzke of the Phoenix Group represented the applicants. He stated <br />that the proposed dock will extend over a wide grassed area and the extra length is <br />needed in order to access sufficient water depth to allow for dockage of a boat. <br />Mr. Govoni read correspondence from the Conservation Commission expressing <br />approval of the project. <br />Mr. Tony Ferragamo, an abutter, expressed approval of the project. No other <br />comments were received from abutters. <br />
