Board of Appeals Minutes--August 11, 1999 5 r <br /> plans of Cape &Islands Engineering dated January 13, 1998, including updated revisions <br /> i <br /> reducing the lot coverage from 2 6%to 22%by eliminating the farmer's porch. z <br /> On May 25, 1999,the Board of Appeals received a request from the applicant for a minor <br /> modification of the Variance (V-98-95). The applicant proposes to eliminate the deck <br /> and replace it with a farmer's porch. The lot coverage will remain at 22%. <br /> At the Public Hearing on Wednesday, June 9, 1999,the Board of Appeals voted <br /> unanimously to grant the Minor Modification of a Variance. , <br /> r <br /> On July 21, 1999, the applicant submitted a request, due to health reasons, for a <br /> six-month extension of Variance V--98-95. <br /> Sitting: Richard T. Guerrera, Robert G. Nelson and James M. Dorgan. Mr. Regan and <br /> Mr. Govoni stepped dow <br /> n wn and left the room. <br /> t <br /> Mr. Nelson moved to grant a six-month extension of the Variance. Mr. Dorgan ' <br /> seconded. All agreed. ,a <br /> Appointment of one Member to Appeals Board <br /> Mr. Hauck submitted copies of the Mashpee Code Book for the Board to examine.He <br /> L <br /> stated that the Appeals Board was formed a few years ago. It was designed to consist of <br /> three members: a Planning Board Member, a Zoning Board of Appeals Member and the ;. <br /> Director of the Department of Public works. Mr. Hauck explained that the Appeals <br /> Board operates in much the same manner as the Zoning Board of Appeals. If the <br /> Planning Board makes a decision denying a petition,the applicant has the right, within 20 ` <br /> days,to appeal to the (Planning)Appeals Board. If the Appeals Board upholds the <br /> Planning Board's decision, the applicant has the right to seek recourse through the court _l <br /> system. However, if no appeal is made within the 20-day period,the Planning Board is <br /> finished with the case and the decision becomes a zoning issue. Mr. Hauck said that <br /> enforcement of the Planning Board decisions are by issuance of building permits. <br /> Mr. Govoni moved to select Mr.Nelson to serve as a member of the Appeals Board. Mr. <br /> Dorgan seconded. All agreed. <br /> MINUTES <br /> Mr. Govoni moved to accept the Minutes of July 14, 1999. Mr.Regan seconded.
