O. Box 1769
Mashpee,Ma 02649
Re: 22 East Way, Assessor's Map 89, Parcel 77
26 East Way, Assessor's Map 89, Parcel 75
Dear Mr. Gildea,
The above parcels are in an "as of right by zoning" cluster subdivision which was
approved and released in 1974 by the Planning Board. The parcels obtain their
frontage from River Road which is listed as a road in the town and their access to
East Way, a paved road, meets the requirements of 174-32.
One point beyond my ability to determine is paragraph one of page 2 on the
discrepancy between the recorded copy and the"marked in ink" copy in the
Planning Department which states these lots are not buildable. I do not want to place
a potential buyer in jeopardy with my lack of knowledge of legal matters.
The above parcels have sufficient frontage, each parcel is of sufficient size, the
parcels have access to a paved road and the road covenant has been released. To
protect any potential buyer I am denying building permits on the above parcels.
This gives you the right to appeal this decision to the Board of Appeals. Through
the appeal process it will give all parties access to legal proceedings under law
regardless of the Board of Appeals decision,
Sincerely,
William F. Hauck
Building Commissioner
