i <br /> ��gUtYry� <br /> Town of Mashpee <br /> BOARD OF APPEALS 16 Great J,Veek Poad,North <br /> Alastipee, Massachusetts 92649 <br /> Decision for a Variance and Special Permit <br /> RE: Barbara B.Nichols SP-99-52 59 Jones Road <br /> Map 21 Block 1 <br /> A Petition was filed on May 26, 1999 by Barbara B.Nichols for a Special Permit <br /> under Section 174-17 of the Zoning By-laws for an addition to a non-conforming <br /> dwelling and a Variance from Section 174-33 of the Zoning By-laws to vary the setback <br /> requirements from the water and the wetlands to allow for construction of a deck on <br /> property located in an R-5 zoning district at 59 Jones Road(Map 21 Block 1)Mashpee, <br /> MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on June 29 and July 6, 1999, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 14, 1999, at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Robert G.Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town <br /> of Mashpee Zoning By-laws. <br /> Mrs.Nichols represented her application and stated that the cabin was built in <br /> 1938. Mrs.Nichols said she proposes to add a deck to the small,non-conforming <br /> structure that currently has only one entrance and exit. <br /> The Board reviewed the plans and confirmed that the dwelling predates zoning <br /> by-laws. <br /> The Conservation Commission has approved the project. <br /> s <br /> No comments were received from abutters. <br /> i <br /> i <br /> I <br /> i <br /> { <br />
