Board of Appeals Ockway Bay Heights Realty Trust SP-99-54 2 <br /> (20%)of the approved dwelling units in any other type of residential or mixed-use <br /> development under a special permit". <br /> Mr. William F. Hauck,Building Commissioner, confirmed that, due to growth <br /> management constraints,the Building Department has issued the two building permits <br /> allowed for the subdivision for 1999. The applicant will have to wait until 2000 in order <br /> to obtain a building permit for construction of the dwelling, making the lot unbuildable at <br /> the present time. <br /> Mr. Marshall Brem, an abutter, expressed approval of the project. No other <br /> comments were received from abutters. <br /> FINDINGS <br /> General Findings <br /> 1. the subject lot is located at 19 Harbor Ridge Drive, fronts on Ockway Bay and <br /> consists of 1.55 acres of land. <br /> Special Permit Criteria <br /> Section 174-25.I.9 states that the Board must find that the structure will not <br /> unduly interfere with the free passage of travel by water or land or cause or contribute to <br /> the substantial disruption or degradation of the marine or coastal environment. <br /> Specific Findings <br /> 1. the proposed dock will be an accessory to an existing dwelling and is a <br /> permissible use upon the grant of a Special Permit. <br /> 2. the proposal has been reviewed by the Harbormaster whose responsibilities <br /> include safety on the water and protection of the marine environment. <br /> 3. the proposal has been reviewed by the Conservation Commission to address <br /> impacts on the coastal environment. <br /> 4. the use is in harmony with the general purpose and intent of the By-laws. <br /> 5. rights to maintenance in perpetuity. <br /> In view of the foregoing,the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Special Permit. Upon motion duly made <br /> and seconded, the Board of Appeals voted unanimously on July 14, 1999 to grant the <br /> Special Permit. The permit is conditioned upon compliance with plan of The BSC <br /> Group, entitled"Site Plan,Assessor's Map 104 Lot 119, 19 Harbor Ridge Estates in <br /> Mashpee, Massachusetts (Barnstable County), April 22, 1999,Prepared for Elisa Entine <br /> Realty Trust, c/o Elisa& Gerald Entine, 31 Holly Road,Newton,MA 02168-1448". <br /> i <br /> i <br />
