F,6U11N <br /> Town ofNashpee <br /> BOARD OF APPEALS 16 Great Xeck Pvoad Xorth <br /> Mashpee, Massachusetts 02649 <br /> Decision for a Six-month Extension <br /> RE: Ockway Bay Heights Realty Trust V-98-92 19 Harbor Ridge Drive <br /> Map 104 Block 119 <br /> A Petition was filed on May 28, 1998 by Ockway Bay Heights Realty Trust of <br /> Newton, Massachusetts for a Variance under Section 174-25.I.9 of the Zoning By-Laws <br /> for permission to exceed the 70 foot pier length limit to allow for a 76 foot pier, ramp and <br /> float on property located in an R-3 zoning district at 19 Harbor Ridge Drive (Map 104 <br /> Block 119)Mashpee, MA. <br /> The Board of Appeals voted unanimously on July 22, 1998 to grant the Variance <br /> to allow for a pier length of 76 feet, <br /> On July 14, 1999, Mr. Norman Hayes of the BSC Group submitted a request for a <br /> six-month extension of the above-referenced Variance. <br /> At the Public Hearing on July 14, 1999,the Board voted unanimously to extend a <br /> six-month extension of Variance V-98-92. The extension will lapse February 4, 2000. <br /> This was allowed in compliance with Massachusetts General Laws Chapter 40A, Section <br /> 10, which reads "If the rights authorized by a variance are not exercised within one year <br /> of the date of grant of such variance such rights shall lapse; provided, however,that the <br /> permit granting authority in its discretion and upon written application by the grantee of <br /> such rights may extend the time for exercise of such rights for a period not to exceed six <br /> months; and provided, further,that the application for such extension is filed with such <br /> permit granting authority prior to the expiration of such one year period". <br /> 9 <br /> IN FAVOR: <br /> Edward M.
