Brown, Trustee). <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on June 29 and July 6, 1999, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 14, 1999, at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town <br /> of Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape &Islands Engineering represented the applicant and <br /> stated that the subdivision was developed in 1913, long before current Zoning By-laws. <br /> The narrow shape of the lot,the proximity to the wetlands and an unpaved road <br /> necessitate the request for Variance relief. The Conservation Commission and the Board <br /> of Health have approved the project. <br /> Mr. Govoni read a letter from Deputy Chief Hamblin of the Mashpee Fire <br /> Department expressing concern with accessing a dwelling on an unpaved road during an <br /> emergency. <br /> Ms. Shirley Granfield, an abutter, expressed concerns regarding the small size of <br /> the lot and the size of the proposed project. <br /> Mr. James Callaway, a realtor, stated that he is in the process of buying two <br /> cottages that are across fiom the subject property. He expressed approval of the project. j <br /> Mr. Joseph Daniele of 225 Monomoscoy Road indicated his approval of the <br /> proposal. <br />
