Power V-99-53 47 Waterline Drive South <br /> Map 120 Block 146 <br /> A Petition was filed on May 28, 1999 by John R. and Cathy D. Power of <br /> Medfield, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws <br /> for permission to vary the sideline setback requirements to allow for construction <br /> of a deck on property located in an R-3 zoning district at 47 Waterline Drive South <br /> (Map 120 Block 146)Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on June 29 and July 6, 1999, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 14, 1999, at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Robert G.Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town <br /> of Mashpee Zoning By-laws. <br /> Mr. Power represented his application and stated that due to Conservation <br /> Commission concerns,he is looking for. a sideline variance of 6 feet on one side of his <br /> property to allow for the addition of a deck to his home. <br /> Mr. Govoni read the letter from an abutter,Mr. Gary Locarno, in opposition to the <br /> project. The Board of Appeals granted Mr. Locarno a Variance on the same sideline in <br /> 1998. He expressed concern with the "feeling of openness"being adversely affected by <br /> the proposed project. <br /> Mr. Power informed the Board that he and Mr. Locarno have already agreed on <br /> plans for a retaining wall which Mr. Power proposes to install, at his own expense, <br /> between the two properties. 1 <br /> i <br /> i <br />
