Introduction This correspondence is a formal appeal of the Building Inspector's denial of Mr. Kenneth Litvack's (the "Applicant's") application for a building permit for the construction of a garage at the above-referenced property. This building permit application was filed as a new, complete building permit application and was submitted to Mr. William Hauck, Town of Mashpee Building Inspector (the "Building Inspector") on or about May 20, 1999. It is our position that the Building Inspector's denial of this building permit application was unmerited, unsubstantiated, and inappropriate, as will be detailed below. Furthermore, Mr. Hauck's denial correspondence, which was dated June 2, 1999, was submitted to our office in an untimely manner and failed to address the full scope of our analysis. This appeal is taken pursuant to M.G.L. c.40A, §8. According to M.G.L. c.40A, §8, [a]n appeal to the permit-granting authority as the zoning ordinance or by-law may provide, may be taken by any person aggrieved by reason of Southeastern Mass.
