Board of Appeals Minutes—August 25, 1999 3 <br /> Attorney Creedon stated that the Variance being sought for Lots#25 and#26 is for <br /> permission to construct on lots that are not within 150 feet of a paved access road. <br /> Attorney Creedon stated that the Zoning By-laws create a hardship for the applicant and <br /> that the Board can grant the Variance without detriment to the public good or derogating <br /> from the intent of the By-laws. <br /> Mr. Paul Flaherty of 34 Daniels Island Road expressed concerns of the impact the <br /> development of the two lots will have on the Conservation area. Mr. Govoni informed <br /> Mr. Flaherty that the Conservation Commission has issued a new order of conditions that <br /> the applicant must comply with in order to develop the lots. Mr. Hauck said that the <br /> Conservation area is behind the subject properties. <br /> Mr. Govoni read a letter from the Fire Department with concerns about accessing the lots <br /> on the dirt road during an emergency. The Fire Department suggested installing indoor <br /> sprinkler systems or providing hydrants on the road as alternatives to hard surfacing the <br /> road. The Fire Department suggests these alternatives to reduce the loss to the home <br /> owners and the town in event of a fire at one of these locations. <br /> Mr. Govoni moved to grant the Variance from Section 174-32 to allow for construction <br /> of a home on property located at Map 111 Block 23. Findings/criteria—same as 1993 <br /> Variance granted on the subject property,that it has been maintained as a separate <br /> buildable lot,that the proposal has been approved by the Conservation Commission and <br /> the Conservation Commission has required the installation of a stone road, rather than a <br /> paved road. The permit is conditioned upon the following: that there will be no left hand <br /> turn allowed and signs will be installed to that effect. Ms. Elizenber7y seconded. All <br /> agreed. <br /> Mr. Govoni moved to grant the Variance from Section 174-32 to allow for construction <br /> of a home on property located at Map 111 Blocks 25 and 26. Govoni,Richard T. Guerrera and Zella E. Elizenberry. <br />
