Laffert&Alicia T. Brophy SP-99-76 146 Summersea Road <br /> Map 105 Block 58 <br /> A Petition was filed on August 16, 1999 by Donald A. Laffert and Alicia T. <br /> Brophy of Needham, Massachusetts for a Special Permit under Section 174-17 of <br /> the Zoning By-laws for permission to demolish an existing dwelling and to rebuild <br /> a single-family home within the same footprint on property located in an R-3 zoning <br /> district at 146 Summersea Road(Map 105 Block 58)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on September 3 and <br /> September 10, 1999, a copy of which is attached hereto and made a part hereof. <br /> The Zoning Board of Appeals received a fax on September 14, 1999 from Cape & <br /> Islands Engineering on behalf of the applicants. A request was made for a continuance of <br /> the applicants' hearing until November 10, 1999 to allow the architect to complete <br /> elevation plans. <br /> On September 22, 1999 the Board voted to continue the hearing until November <br /> 10, 1999. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday,November 10, 1999, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Robert G. <br /> Nelson and Zella E. Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> At the Public Hearings on November 10, 1999, Mr. John Slavinsky represented <br /> the applicants. The Conservation Commission and the Board of Health have approved <br /> the project. A new Title V Septic System will replace an existing leaching facility on the <br /> property. Mr. Laffert also attended the meeting. <br /> The applicants are seeking permission to tear down the existing structure, to build <br /> a new single-family dwelling within the same footprint and to build an addition. A <br /> Variance relief of approximately 40 feet to the wetlands is being requested. <br /> No comments were received from abutters. <br />
