rte.,.._ ,••syr Town of Mashpee <br /> 16 Great JVeck Xoad JVorth <br /> w Mashpee, Alassachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> RE: Kevin & Linda Van Haren SP-99-74 Map 3 Block 21 <br /> 86 Pimlico Pond Road <br /> A Petition was filed on August 11, 1999 by Kevin and Linda Van Haren of <br /> Mashpee, Massachusetts for a Special Permit under Section 174-25.I.9 of the Zoning <br /> By-laws for permission to construct a pier, ramp and float on Wakeby Pond on property <br /> located in an R-5 zoning district at 86 Pimlico Pond Road(Map 3 Block 21) Mashpee, <br /> MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on September 3 and <br /> September 10, 1999, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 22, 1999, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, Zella E. <br /> Elizenberry and Robert G.Nelson. James E. Regan III stepped down and left the room. <br /> This Decision is issued by the Mashpee Zoning Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the applicants and <br /> stated that the proposal is for the construction of a floating structure. The Harbormaster <br /> rejected the original proposal for a permanent structure because fresh water ice can <br /> uproot that type of structure. The Conservation Commission has approved the plan. <br /> Mr. Govoni questioned if the subject lot has been subdivided. Mr. Slavinsky <br /> confirmed that it has been divided into two lots. Mr. Govoni requested Mr. Slavinsky to <br /> submit a copy of the land court plan showing the two separate lots. <br /> No comments were received from abutters. <br />
