rte.,.._ ,••syr Town of Mashpee 16 Great JVeck Xoad JVorth w Mashpee, Alassachusetts 02649 MASHPEE ZONING BOARD OF APPEALS Decision for a Special Permit RE: Kevin & Linda Van Haren SP-99-74 Map 3 Block 21 86 Pimlico Pond Road A Petition was filed on August 11, 1999 by Kevin and Linda Van Haren of Mashpee, Massachusetts for a Special Permit under Section 174-25.I.9 of the Zoning By-laws for permission to construct a pier, ramp and float on Wakeby Pond on property located in an R-5 zoning district at 86 Pimlico Pond Road(Map 3 Block 21) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on September 3 and September 10, 1999, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, September 22, 1999, at which time the following members of the Zoning Board of Appeals were present and acting throughout: Edward M. Govoni, Zella E. Elizenberry and Robert G.Nelson. James E. Regan III stepped down and left the room. This Decision is issued by the Mashpee Zoning Board of Appeals pursuant to the provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of Mashpee Zoning By-laws. Mr. John Slavinsky of Cape & Islands Engineering represented the applicants and stated that the proposal is for the construction of a floating structure. The Harbormaster rejected the original proposal for a permanent structure because fresh water ice can uproot that type of structure. The Conservation Commission has approved the plan. Mr. Govoni questioned if the subject lot has been subdivided. Mr. Slavinsky confirmed that it has been divided into two lots. Mr. Govoni requested Mr. Slavinsky to submit a copy of the land court plan showing the two separate lots. No comments were received from abutters.
