Marshall Brem and Fre <br /> derick R. f <br /> Borgeson, Associate member candidates, also attended the meeting. <br /> g <br /> Y E� <br /> Fred Glass -Requests a Variance from Sections 174-31 174-85 and 1 - =74 86.F. of the <br /> Zoning By-laws for permission to construct a new dwelling within the ACE C and to vary <br /> the front yard setback requirements on property located in an R-3 zoning <br /> . �Y g district at 133 . <br /> Tide Run(Map 120 Block 180)Mashpee, MA. (Owner of record: P & S <br /> . Goldstein <br /> Family Trust). <br /> Sitting: James E. Regan III, Robert G. Nelson and Richard T. Guerrera. <br /> The applicant withdrew the request to vary the front setback requirements. The .r <br /> q e Zoning <br /> Board of Appeals voted unanimously on April 28, 1999 to ant the Variance allowing <br /> owing � <br /> the applicant to construct a new home within the ACEC. LA <br /> On August 23, 1999 the Zoning Board of Appeals received a written <br /> pp request from Cape � <br /> r <br /> &Islands Engineering on behalf of the applicant. The applicant is seeker a modification <br /> pp g dific anon I �� <br /> of Variance V-99-24. The modification will include an increase in the square q footage of E <br /> the proposed dwelling. The construction will comply with all front side an <br /> . p Y d rear setback . <br /> r <br /> requirements. <br /> I. <br /> On September 22, 1999, Mr. John Slavinsky of Cape & Islands Engineering re� g represented <br /> ed <br /> the applicant. Attorney Robert Mills and Mr. and Mrs. Glass also attended the meeting.Slavinsky stated that Diane Boretos, Conservation Agent, arranged for a site visit at <br /> the subject property. Ms. Boretos approved placing the proposed house at the 50-foot p E <br /> setback(from the top of the bank)from the wetlands. Upon submittingplan to the ` <br /> a new <br /> Conservation Commission,the applicants were informed that a buffer beyond the 50-foot <br /> Y � <br /> setback is required. <br /> The new proposal is for the house to be constructed 53 feet from the resource line.ne. The <br /> Conservation Commission has approved the new plans, final revision date of 719199. Mr. <br /> Slavinsky stated that the proposed location of the house will be placed sideways and not <br /> closer to the wetlands. He also stated that the house will not be constructed at an odd <br /> angle on the subject property. The proposal conforms to a 3 o-foot front setback and a _ <br /> 15-foot sideline setback. Mr. Slavinsky stated that the lot coverage is 19.9%, the same as ` <br /> the original plan. The house will be larger, but will occupy the same lot coverage. <br /> a <br /> , r <br />
