Casal V-99-87 21 Bearse Road <br /> Map 117 Block 314 <br /> A Petition was filed on September 7, 1999 by Frank and Ida R. Casal of <br /> East Weymouth, Massachusetts for a Variance from Section 174-31 of the Zoning <br /> By-laws for permission to vary the sideline setback requirements to allow for <br /> construction of a shed on property located in an R-3 zoning district at 21 Bearse <br /> Road(Map 117 Block 314)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on October 8 and October 15, <br /> 1999, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 27, 1999, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Zella E. Elizenberry <br /> and Richard T. Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Casal represented his application and stated that the proposed shed will be 8 <br /> feet by 8 feet. He is requesting a Variance from the side and rear setback requirements. <br /> Trees and other growth will shield the shed. Mr. Casal proposes to use the shed to store <br /> gardening tools. <br /> Mr. Hauck and Mr. Nelson said that they are of the opinion that sheds of a certain <br /> size and of a portable nature should be exempt from zoning requirements. <br /> No comments were received from abutters. <br />
