Regan III, Zella E. Elizenbe rry and Frederick R. Borgeson. Robert G. <br /> Nelson stepped down and left the room. <br /> 'III <br /> Mr. David Sanicki of Cape & Islands <br /> p Engineering represented the applicants and stated <br /> that the hearing was continued to allow the applicant a chance to receive approval from <br /> the Conservation Comu-nission. He said that the 70- <br /> foot pier length has to be exceeded b <br /> 44 feet just to reach one foot of water. The Conservation Commission has y <br /> approved the <br /> construction of a small dinghy dock and will not permit large arge boats to be docked on this <br /> site. The Harbormaster has also approved the 'project. <br /> p � <br /> f�f:f <br /> Mr. Jahn Knudsen and Mr. and <br /> Mrs. Dempsey, abutters, attended the meeting, Th <br /> g ey <br /> claimed that the Conservation Ca ,.mmission did not notify them of the the Z <br /> construction. However, proposed <br /> oning Board of Appeals notified the Knudsens and the <br /> Dempseys of the proposed construction in September. <br /> The abutters claimed that the property is for sale and that •• y at this application is only fora <br /> selling point. They questioned the description of a din <br /> jet <br /> p ghy. They also questioned whetheror not skis would be permitted. Mr. Knudsen asked what would 'be the point of <br /> building this dock in a mud puddle. <br /> Mr. Regan said that the applicant has the <br /> pp prerogative to do so. He also said that the <br /> Board is not expert in those areas and suggested that the abutters • <br /> gg hers seek clarification from <br /> the Conservation Commission and the Harbormaster. Mr Wi 'f <br /> e �'� <br /> . Regan also said that th ` <br /> Conservation Commission refers that a walk-over er structure be constructed as opposed to ' <br /> allowing people to walk through the marsh and ruin it. Mr. 'Regan said the walk-over <br /> structures are also designed to allow light to penetrate throw to the environment <br /> gh <br /> underneath and protect the marsh. <br /> Mr. Borgeson moved to grant a Variance of 44 feet to <br /> allow for construction of the peer, <br /> ramp and float, subject to findings: 1, 2, 3, 4, 5. Ms.Elizenben'y seconded..
