Peros SP-99-96 2 <br /> Board of Appeals <br /> GENERAL FINDINGS <br /> 1. the subject property is located at 16 Bluff Avenue and consists of 7,860 square <br /> feet. <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br /> Law Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. <br /> SPECIFIC FINDINGS <br /> 1. that the proposed addition does not conform to the setback requirements and <br /> the Board has granted a Variance. <br /> 2. that the changes between the proposed addition and the prior one will result in <br /> an increase in lot coverage; however, the lot coverage will be under the <br /> allowed 20%. <br /> 3. that while the proposed addition will increase the non-conforming nature of <br /> the structure, the changes will not result in a structure or use which is more <br /> detrimental to the neighborhood than the prior non-conforming structure and <br /> its use. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on November <br /> 10, 1999 to grant a Special Permit to construct an addition to a non-conforming dwelling <br /> on property located in an R-3 zoning district at 16 Bluff Avenue. The Special Permit is <br /> conditioned upon compliance with plan entitled: "Addition and Septic System Upgrade, <br /> Proposed Sewage Disposal System, Prepared for William Peros, Hse. No.16 Bluff Ave., <br /> Mashpee—Mass., Date: Sep. 20, 1999, Plan No. S092099, Rev: 11/8/99, Cape & Islands <br /> Engineering". <br />
