Emmons of Mashpee, Massachusetts <br /> for a Special Permit under Section 174-25.I.9 of the Zoning By-laws for permission to <br /> construct a pier, ramp and float on Popponesset Bay on properties located in an R-3 <br /> zoning district at 80 and 84 Punkhorn Point Way(Map 100 Blocks 4 and 5) Mashpee, <br /> MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on October 22 and October 29, <br /> 1999, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, November 10, 1999, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Robert G. <br /> Nelson and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the applicants. He <br /> stated that the Hesslers are currently constructing a new home on the subject property. <br /> Mrs. Hessler also attended the meeting. <br /> The Conservation Commission, the Harbormaster and the Shellfish Constable <br /> have all approved the proposed dock. Mr. Slavinsky said that the Conservation <br /> Commission has only approved a small, dingy dock. <br /> Mr. Slavinsky stated that the joint filing was required because the proposed site of <br /> the dock would cross a neighbor's piece of property. He stated that the applicants <br /> propose to make a land transfer and a subdivision hearing by the Planning Board has <br /> been scheduled. <br />
