V-99-101 52 Summersea Road <br /> Map 105 Block 31 <br /> A Petition was filed on October 6, 1999 by Chilton Development Group, Inc. of <br /> Mashpee, Massachusetts for a Variance from Section 174-33 of the Zoning By-laws for <br /> permission to vary the setback from the water and the wetlands to allow for construction <br /> of a single-family dwelling on property located in R-3 and S-3 zoning districts at 52 <br /> Summersea Road(Map 105 Block 31) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on October 22, and October <br /> 29, 1999, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, November 10, 1999, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Robert G. <br /> Nelson and Frederick R. Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Chris King of the Phoenix Group represented the applicant and stated that <br /> the Conservation Commission and Board of Health have approved the proposal. He <br /> submitted a letter from Health Agent Elias McQuaid approving the construction of a <br /> four-bedroom home on the subject property. <br /> Mr.Nelson and Mr. Regan expressed concern with the plan indicating that the <br /> coastal bank seems to stop and start in different areas of the subject lot. Mr. King stated <br /> that the plan does follow current state and town regulations for determining the location <br /> of the coastal bank. He said that due to the severe slope and topography of the lot,the <br /> coastal bank could seem to disappear from one area and then reappear in another area of <br /> the lot. <br /> No comments were received from abutters. <br /> I <br />
