(Owner of record: Michael H. & Julian H. Katzeff and <br /> Thomas B. Concannon, Jr., Trustees). <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on October 22; and October <br /> 29, 1999, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, November 10, 1999, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Robert G. <br /> Nelson and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the applicant and <br /> stated that there are currently many existing homes on Horseshoe Bend Way, an unpaved <br /> road. The Conservation Commission and the Board of Health have approved the project. <br /> The project meets all setback requirements to the wetlands. The applicant is seeking <br /> Variance relief to construct a home on an unpaved road. <br /> Mr. Regan read the memo from the Fire Department with concerns about access <br /> by fire and emergency apparatus to a dwelling constructed on an unpaved road. <br /> Mr. Nelson said that at the last meeting Mr. Hauck informed the Board that they <br /> have no authority to enforce the installation of sprinklers inside a home. <br />
