AM:(,ss Town of Mashpee <br /> 4� <br /> MASHPEE ZONING BOARD OF APPEALS 16 Great Aeck Poad Arth <br /> Mashpee, Massachusetts 02649 <br /> Decision for a Variance <br /> RE: Howard Glaser V-99-114 403, 397 Great Oak Road <br /> Map 126 Blocks 48 & 49 <br /> A Petition was filed on October 29, 1999 by Howard Glaser of Sharon, <br /> Massachusetts for a Variance from Sections 174-85 and 174-86 of the Zoning <br /> By-laws for permission to vary the setback requirements from the ACEC to allow <br /> for construction of a single-family dwelling on property located in an R-3 zoning <br /> district at 403 Great Oak Road(Map 126 Block 48) Mashpee, MA. (Owner: New <br /> Seabury Properties LLC.) <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on November 19 and <br /> November 26, 1999, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 8, 1999, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Frederick R. <br /> Borgeson and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the applicant, Mr. <br /> Glaser, who also attended the meeting. Mr. Glaser requested permission from the Board <br /> to combine two lots, Map 126 Blocks 48 and 49, and construct only one house on the <br /> combined lot. A Variance of 22 feet from the ACEC is being requested in order to meet <br /> the 30-foot setback requirement from the street. <br /> The Conservation Commission has approved the project. <br /> Mr. Regan commented that the proposal is an improvement of previous petitions <br /> from other applicants who sought to build three houses on three very small lots in that <br /> area. <br />
