r C IL ADDENDUM A After further remarks in explanation of this application: Applicant was issued a special permit SP 84-04-024, filed with the Town Clerk on July 10, 1986. The Special Permit granted the applicant the right, with certain conditions, to operate and build a retail/office/restaurant and residential complex. Since that date, applicant (formerly known as Fields Point Corporation and now known as Mashpee Commons Limited Partnership) has been operating under and in conformance with the Special Permit, as well as subsequent minor revisions to the special permit, most recently referenced by SP-99-49. Applicant requests to make minor revisions to Building 15, previously approved under SP-99-44, such minor revisions to include 3,820 square feet in a single story addition to the north side of the building, as provided for under Condition Number 5 of SP-86-04-024. Such minor changes are permitted under the C-I zone of the Zoning Ordinance, are consistent with applicable law, rules and regulations, are in general conformance with the existing Special Permit, will not increase the intensity of use of the site and will result in a more aesthetically pleasing plan. As per Condition Numbers I and 5 of SP-986-04-024, and as provided for under SP 99-14 and SP-99-49, applicant is requesting that such minor revision to Building 15 be approved by the Mashpee Zoning Board of Appeals whereby Building 15 will comprise a total of 21,820 square feet.
