Domolky V-99-105 26 Spoondrift Circle <br /> Map 111 Block 120 <br /> A Petition was filed on October 7, 1999 by George C. & Susan Y. Domolky of <br /> Mashpee, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the side setback requirements to allow for construction of an addition <br /> to an existing home on property located in an R-3 zoning district at 26 Spoondrift Circle <br /> (Map 111 Block 120)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on November 19 and <br /> November 26, 1999, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 8, 1999, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Robert G. <br /> Nelson and Zella E. Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Chris King of the Phoenix Group represented the petition and stated that the <br /> applicants propose to expand the existing bedroom and bath by a total of 100 square feet. <br /> Mr. King reminded the Board that it had previously.granted the applicants a Special <br /> Permit to allow for construction of a pool. The applicants are now seeking a further <br /> Variance relief of 11.5 feet from the side setback requirements to allow for the addition. <br /> The proposed construction would be 3.5 feet from the easterly lot line. <br /> Mr. Hauck, Building Commissioner, reviewed the plan and a brief discussion with <br /> the Board followed. The Board questioned the exact measurement of the proposed <br /> addition,the necessity for the proposed addition and the nature of the applicants' <br /> hardship. <br />
