Cleary V-99-109 4 Wheelhouse Lane <br /> Map 120 Block 155 <br /> A Petition was filed on October 20, 1999 by Thomas J. & Joan D. Cleary of <br /> Mashpee, Massachusetts for a Variance from Section 174-33 of the Zoning By-laws for <br /> permission to vary the setback requirements from the ACEC to allow for construction of <br /> an addition to an existing home on property located in an R-3 zoning district at 4 <br /> Wheelhouse Lane (Map 120 Block 155)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on November 19 and <br /> November 26, 1999, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 8, 1999, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Robert G. <br /> Nelson and Frederick R. Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Chris King of the Phoenix Group represented the applicants and stated that <br /> the existing dwelling is a three-bedroom home. A new Title V septic system is currently <br /> being installed on the subject property. Mr. King said that the proposed expansion of the <br /> existing bedroom and the existing deck require a Variance from the water and wetlands. <br /> The Conservation Commission has issued an order of conditions. <br /> Mr. Guerrera questioned the reason for a"future" sunroom as shown on the plans. <br /> Mr. King said that be believes that the sunroom would not be constructed because the <br /> Conservation Commission has not approved the proposed sunroom. <br /> Mr. Regan remarked that the plan is not valid because it shows a sunroom and <br /> a proposed four-bedroom home, but that Mr. King represented the proposal as a <br /> three-bedroom home. Mr. Regan said that the Board could not render a decision with <br /> inaccurate plans and suggested that the hearing be continued until the engineer could <br /> submit accurate plans. <br /> No comments were received from abutters. <br />
