Mashpee Zoning Brickyard Marketplace Nominee Trust SP-99-115 3 <br /> Board of Appeals <br /> In view of the foregoing, the Zoning Board of Appeals voted unanimously on <br /> December 8, 1999 to grant the Special Permit to allow for use by a bank and for use for <br /> other retail services with the following conditions and modifications: <br /> 1. that the phrase "doughnut shop" shall be deleted from the Special Permit petition. <br /> 2. that an eight-foot high fence shall be installed. <br /> 3. that a fence with gates shall enclose the dumpsters on the property. <br /> 4. that if the drive-through window is used for retail use,the window shall be used <br /> as incidental to the business that would occupy that retail space. <br /> 5. that the tenant using the space appear before the Zoning Board of Appeals with a <br /> definition of the use of the space. <br />
