The Special Permit also required tree f <br /> planting or fencing between the motel and 78 Main Street. Mr. Peters said that it would <br /> take a zoning change to include 78 Main Street, which is residential, as part of the motel <br /> business. He also expressed concern with the owners selling the property and <br /> establishing apartments in the motel. Mr. Peters voiced no fiirther problems,with the <br /> proposal. <br /> Mr. Regan read a letter from the Fire Department expressing no objections with the <br /> proposal at this time. <br /> No other comments were received from abutters. <br /> Mr.Nelson moved to continue the petition until January 26, 2000 to allow the applicant ' <br /> an opportunity to modify the Appeal and to seek legal counsel. Ms.Elizenberry <br /> seconded. All agreed. <br /> i <br /> Patricia A. Regan III, Robert G.Nelson and Marshall Brem. <br /> Mr. Michael McGrath of Holmes and McGrath represented the applicant and stated that <br /> i <br /> the proposal is for the construction of a 24 x 32-foot home with a 20 x 20-foot A � <br /> garage. <br /> deck with steps is also planned in the back of the house. <br /> The Conservation Commission has already issued an order of conditions and the Board of <br /> Health has also approved the project. Mr. McGrath informed the Board that the applicant �. <br /> proposes to install a new and efficient septic system. <br /> Mr. McGrath stated that the steep bank, shape, soil conditions and topography of the <br /> i. <br /> subject property pose a hardship and necessitate Variance relief. He also stated that the ` <br /> and has moved and there is a wetland on the subject roe now. This has caused the <br /> P J property�y <br /> proposed location of the house to be closer to the street than current zoning By-laws <br /> allow. Mr. McGrath requested that the Board determine that the subject lot has unique <br /> circumstances and that the Board grants a Variance of 10 from the front setback <br /> d <br /> requirements and a Variance of 15 feet from the water and wetlands. <br /> E <br /> Mr.Nelson suggested that the Board also consider granting a Variance from the frontage <br /> r <br /> requirements. Mr. Hauck informed the Board that a Variance from the frontage <br /> requirements is not necessary for this petition. <br /> Mr.Nelson questioned the grades as shown on the plan.
