Town of Mashpee <br /> 3 <br /> 16 Great Neck P�oad Arth <br /> BOARD OF APPEALS Mashpee, Massachusetts 02649 <br /> Decision for a Variance <br /> RE: John Costa - V-98-6 105 Waterline Drive South <br /> Map 125 Block 247 <br /> A Petition was filed on December 15, 1997 by John Costa of Wayland, <br /> Massachusetts for a Variance from Sections 174-31 and 174-33 of the Zoning By-laws for <br /> permission to vary the front and side line setback requirements and the setback from the <br /> wetlands. The applicant proposes to construct a single family home with a front setback <br /> of 23.2 feet from Waterline Drive South, a side line setback of 9 feet on the North side <br /> and a setback of 35 feet from the edge of the wetlands. The property is located in an R-3 <br /> zoning district at 105 Waterline Drive South(Map 125, Block 247). (Owner of record: <br /> Pamela C. Feldman, TR.) <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on January 9 and January 16, 1998, a copy <br /> of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 28, 1998 and continued to March 11, 1998 at which time the <br /> following members of the Board of Appeals were present and acting throughout: Edward <br /> M. Govoni, Michael A. Makunas and James M. Dorgan. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Engineer Michael Grotzke represented the applicant and presented plans for the <br /> construction of a house 35 feet from the edge of the wetlands. The hearing was continued <br /> to allow the Conservation Commission to review and approve the plans. Revised plans <br /> were presented at the March 11, 1998 meeting which included a chain fink fence to <br /> protect the wetlands and a reduction in the size of the foundation to protect the work area <br /> at the rear of the house. <br />
