Town of Mashpee
s
16 Great JVeck goad JVorth
BOARD OF APPEALS Mashpee, Massachusetts 02649
Decision for a Special Permit
RE: Half Tide Marina, Inc. - SP-98-12 103 Industrial Drive
Map 88, Block 28
A Petition was filed on December 23, 1998 by Half Tide Marina Inc. of Mashpee,
Massachusetts for a Special Permit under Section 174-25.G.9 of the Zoning By-laws for
open lot storage of boats in an I-1 zoning district on property located at 103 Industrial
Drive (Map 88,Block 28) Mashpee, MA. (Owner of record: Mashpee Industrial Park
Realty Trust, Paul DeRuyter, Trustee).
Notice was duly given to abutters in accordance with Massachusetts General Laws
Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper
of general circulation in the Town of Mashpee, on January 23 and January 30, 1998, a
copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, February 11, 1998 at 7:30 P.M. at which time the following members of the
Board of Appeals were present and acting throughout: Edward M. Govoni, James E.
Regan III and Cheryl A. Hawver.
This Decision is issued by the Mashpee Board of Appeals pursuant to the
provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of
Mashpee Zoning By-laws.
Robert Scozzari, President of Half-Tide Marina, Inc. represented the Petition and
informed the Board that he had received a Special Permit for boat storage on another lot
in the Mashpee Industrial Park but the owner of the Park had opposed the location. He
stated that there is now an agreement to change lots and that the proposed location at 103
Industrial Drive would be removed from the agreement of the Mashpee Industrial Park
and the Cape Cod Commission. Correspondence was presented from the Cape Cod
Commission confirming the transfer. The Board was informed that boat storage will be
confined to boats built after 1986. The proposed plans include a 75 foot buffer between
the residential and commercial zones.
