Locarno TR.- V-98-5 51 Waterline Drive South <br /> Map 120 Block 145 <br /> A Petition was filed on December 12, 1997 by Gary M. Locarno TR. of Boston, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the front and side setback requirements to allow a front setback of 24.1 feet and a <br /> side setback of 9.01 feet on the north side on property located in an R-3 zoning district at <br /> 51 Waterline Drive South(Map 120, Block 145)Mashpee, MA, <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on January 23 and January 30, 1998, a <br /> copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 11, 1998, at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br /> Cheryl A. Hawver. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 <br /> of the Town of Mashpee Zoning By-laws. <br /> Engineer Michael Grotzke represented the applicant and presented house plans for <br /> a lot on Great River. He informed the Board that the plans conformed to the 50' setback <br /> requirement from wetlands but required variances in the front and side setback <br /> requirements. Comments were received from three abutters opposed to the construction <br /> and one in favor. <br /> The Board determined that the applicant did not prove a hardship in the need for a <br /> variance of the front setback requirements. Upon motion duly made and seconded the <br /> Board of Appeals voted unanimously on February 11, 1998 to deny the application <br /> without prejudice. <br />
