Brennan of <br /> Wayne, Pennsylvania for a Variance from Section 174-25.I.9 of the Zoning By-laws for <br /> permission to exceed the 70 foot dock length limit to allow a 192 foot dock on Ockway <br /> Bay on property located in an R-3 zoning district at 38 Fiddler Crab Lane (Map 105, <br /> Block 102)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on February 6 and February 13, 1998, a <br /> copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 25, 1998 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Cheryl A. Hawver. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Engineer Norman Hayes represented the applicant and reviewed plans for a dock <br /> and float which have been approved by the Conservation Commission and the <br /> Harbormaster. No comments were received from abutters. He informed the Board that <br /> the proposed dock requires a length of 192 since it crosses the New Seabury reserve land <br /> at the rear of the lot. <br /> 1 <br />
