The Plaintiff is an individual with an address of 11 Taffrail Way, Mashpee, <br /> Barnstable County, Massachusetts. <br /> 2. The Defendants are individuals who, in their official capacity, serve as the Board of <br /> Appeals for the Town of Mashpee, with an address of Town Hall, Mashpee, Barnstable <br /> County, Massachusetts. The residential address of the Defendants is as follows: <br /> James E. Regan III--16 Brookside Circle, Mashpee, MA 02649 <br /> Michael A. Makunas--119 James Circle, Mashpee, MA 02649 <br /> Robert G. Nelson--Tradewind Drive, Mashpee, MA 02649 <br /> 3. On May 26, 1998, the Defendants issued two decisions on applications by the <br /> Plaintiff to build a garage/home office on his property at 11 Taffrail Way in Mashpee, <br /> purporting to deny both a request for Special Permit and Variance, copies of which are <br /> attached as Exhibits "A" and 'B". <br /> 4. The decisions attached hereto as Exhibits ""A and 'B" exceed the authority of the <br /> Board, and are invalid on their face. The Plaintiff is aggrieved by said decisions. <br />
