Town of Nashpee <br /> s d <br /> 16 Great JVeck 4koad JVorth <br /> n'u,E c.�` BOARD OF APPEALS Mashpee, Massachusetts 02649 <br /> Decision for a Variance <br /> RE: Lillian Bern- V-98-21 24 Tide Run <br /> Map 126 Block 29 <br /> A Petition was filed on February 5, 1998 by Lillian Bern of Mashpee, <br /> Massachusetts for a Variance from Sections 174-31 and 174-33 of the Zoning By-laws for <br /> permission to vary the side setback and setback from wetlands requirements to allow the <br /> construction of a swimming pool 7 feet from the easterly side line and 20 feet from the <br /> edge of the wetlands on property located in an R-3 zoning district at 24 Tide Run(Map <br /> 126, Block 29) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on March 6 and March 13, 1998, a copy of <br /> which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, March 25, 1998 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Michael A. Makunas, <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 <br /> of the Town of Mashpee Zoning By-laws. <br /> Engineer Michael Grotzke represented the applicant and informed the Board that <br /> the lot was impacted by wetlands and the pool was needed for medical reasons. Mr. <br /> Govoni read correspondence from a direct abutter objecting to the proposed pool. <br />
