Special Permit Criteria <br /> Section 174-17 of the Mashpee Zoning By-laws states that nonconforming single <br /> or two-family dwelling structures may be changed, extended or altered if such change, <br /> extension or alteration complies with the dimensional requirements applicable to the lot <br /> under current provisions of 174-31. <br /> Findines <br /> 1. the site contains 13,560 square feet improved with a single family home. <br /> 2. the submitted plans were not in compliance with the provisions of Section 174- <br /> 31 of the Zoning By-laws and required a Variance from the Board of Appeals <br /> for lot coverage, front setback and setback from the wetlands. The Variance <br /> was denied without prejudice. <br /> For the foregoing reason, the Board determined that the applicant did not meet the <br /> criteria necessary for the granting of a Special Permit. Upon motion duly made and <br /> seconded, the Board of Appeals voted unanimously on May 13, 1998 to deny the <br /> application without prejudice. <br /> t <br />
