,rmen <br /> Town of Mashpee <br /> 16 Great JVeck 9(oad JVorth <br /> Mashpee, Massachusetts 02649 <br /> BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION OF SPECIAL PERMIT <br /> Re: Petition of Dick 'n Ellie's Flea Market 650 Falmouth Road <br /> Albert Wiseman, Manager - SP-98-31 Map 81, Block 4 <br /> A Petition was filed on March 2, 1998 by Albert Wiseman, Manager of Dick 'n <br /> Ellie's Flea Market for a renewal of Section 4 of the Modification of Special Permit 95-32. <br /> Section 4 states that: "No structures of a permanent nature are to be constructed, <br /> erected, or caused to be placed on the property used in connection with the flea market. <br /> Merchandise, equipment, banners and other gear for use in connection with the Flea <br /> Market are to be removed at the conclusion of each day's operation. Any poles which are <br /> to be used by the applicant to support tents are not to be considered structures for the <br /> purposes of this permit and canopies and tent sides used on these poles may remain <br /> overnight for the (1997) season. All tent canopies and sides are to be of uniform color. <br /> This condition is subject to renewal before the opening of the (1998) season." The Flea <br /> Market is located in a C-1 zoning district at 650 Falmouth Road(Map 81,Block 4) <br /> Mashpee, MA. (Owner of record: Charles M. Talanian, TR.) <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee on March 20 and March 27, 1998, a copy <br /> of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 8, 1998 at 7:30 P.M. at which time the following members of the Board <br /> of Appeals were present and acting throughout: Cheryl A. Hawver, James E. Regan III <br /> and Robert G. Nelson. <br /> Mr. Wiseman represented the Petition. Comments were received from the Police <br /> Chief requesting the same conditions as in 1997. The Board agreed that the permanent <br /> barrier at the Deer Crossing entrance should be closed from 10 A.M. and 5 P.M. Mr. <br /> Wiseman also agreed to improve the trash pickup at the site. The Board was informed that <br /> the applicant was working with the Police Department to provide space for a teen center <br /> at the site. The Board agreed that a police detail on Columbus Day weekend was not <br /> necessary but that a police detail should be required for Memorial Day and Labor Day. <br /> The Board agreed that all poles used on the site must be removed at the end of the 1998 <br /> season. <br />
