Town ofNashpee <br /> 16 Great Aeck �koad Arth <br /> Mashpee, Massachusetts 02649 <br /> BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Lipnosky Family Trust - V-98-78 123 James Circle <br /> Map 64 Block 67 <br /> A Petition was filed on April 29, 1 998 by the Lipnosky Family Trust for a <br /> Variance from Section 174-31 of the Zoning By-laws for permission to vary the setback <br /> requirements on property located in an R-5 zoning district at 123 James Circle(Map 64, <br /> Block 67)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on April 28 and May 5, 1998, a copy of <br /> which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 13, 1998 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Robert G. Nelson, Cheryl A. <br /> Hawver and James M. Dorgan. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 <br /> of the Mashpee Zoning By-laws. <br /> Attorney Kevin M. Kiffane represented the applicant and informed the Board that <br /> the current zoning required a 50 foot setback from the wetlands which resulted in a 23 <br /> foot front setback from James Circle. No comments were received from abutters. <br />
