The applicant requests that the Board further amend the special permit issued on April 10, <br /> 1974,modified on January 29, 1985, and further amended and modified by decisions dated <br /> September 11, 1986,January 28, 1988, September 21, 1988, October 14, 1988 and November <br /> 22, 1989 as follows: <br /> By deleting condition 47 as previously amended,which reads as follows: <br /> "The water system for the first fifty units of Phase L as shown on plans by E.J. Flynn Engineers <br /> entitled Pine Mll Estates,Phase IA, dated September 24, 1986, revised January 5, 1989, <br /> attached hereto and made a part hereof,must be completed and substantial work must be <br /> commenced on the sewer system plant amenity center, swimming pools,tennis courts and golf <br /> course prior to the issuance of the first Occupancy Certificate for any dwelling unit; the sewer <br /> system plant the amenity center, swimn-dng pools and tennis courts must be completed prior to <br /> the issuance of the 5 1'Occupancy Certificate. The amenity center, swinuning pools and tennis <br /> courts must be completed before March 30, 1990 and if not able to be completed by this date <br /> due to adverse weather conditions applicant may apply for an extension for an additional 90 <br /> days." <br /> and replacing it with the following: <br /> "The Water system for the first fifty units of Phase t as shown on plans by E.J. Flynn <br /> Engineers entitled Pine IUl Estates,Phase I A, dated September 24, 1986, revised January 5, <br /> 1989, attached hereto and made a part hereof, must be completed and substantial work must be <br /> commenced on the sewer system plant, amenity center, swimming pools,tennis courts and golf <br /> course prior to the issuance of the first Occupancy Certificate of any dwelling unit; the sewer <br /> system plant must be completed prior to the issuance of the 5 1"Occupancy Certificate; the <br /> swimming pools and amenity center shall be substantially completed by March 30, 1999. The <br /> tennis courts shall be substantially complete by the issuance of the Certificate of Occupancy for <br /> the 175'h unit and the golf course shall be substantially complete by the issuance of the <br /> Certificate of Occupancy for the 200 th Unic, <br /> By deleting condition M12 which reads as follows: <br /> Except for a water well field or storage tanks and related facilities, and beach and docks <br /> facilities allowed by the Conservation Commission and Board of Appeals and beach house, the <br /> northern most portion of the premises to the north of Lot 28 shown on Assessors Map 50, shall <br /> not be developed with structures of any kind and shall be preserved permanently for open <br /> space use. <br /> and replacing with the following: <br /> "The northern most portion of the premises, consisting of approximately 13 acres, shall be <br /> conveyed by the property owner to the Town of Mashpee with the condition that this parcel <br /> shall not be developed with structures of any kind and shall be preserved permanently for open <br /> space." <br /> By deleting condition 925. <br />
