Town of Mashpee <br /> 16 Great Xeck !koad Xorth <br /> Alashpee, Massachusetts 02649 <br /> BOARD OF APPEALS <br /> Decision for a Special Permit <br /> RE: Francis I and Nancy I Goulart - SP-98-84 58 Pimlico Pond Road <br /> Map 3 Block 85 <br /> A Petition was filed on May 1, 1998 by Francis I and Nancy I Goulart of <br /> Mashpee, Massachusetts for a Special Permit under Section 174-2519 of the Zoning By- <br /> laws for a seasonal dock on Wakeby Pond on property located in an R-5 zoning district at <br /> 58 Pimlico Pond Road (Map 3, Block 85)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on June 5 and June 12, 1998 a copy of <br /> which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 24, 1998 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Cheryl A. Hawver, Richard T. <br /> Guerrera and James M. Dorgan. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Goulart represented his application and informed the Board that he had a <br /> seasonal wooden pier on Wakeby Pond and requested a waiver in the requirement for <br /> engineered plans. The Board was informed that the Conservation Commission has <br /> approved the structure and that they do not require engineered plans since the DEP <br /> Division of Waterways, under Chapter 9 1, has eliminated the requirement. No comments <br /> were received from abutters. <br />
