Board of Appeals Loewen Group V-98-1 10 2 <br /> Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography that affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner, <br /> FINDINGS <br /> 1. the shape and topography affect the lot and not the zonin� district in which it is <br /> located. <br /> 2. a hardship is created by the odd shape. f/the lot and Lwing of the <br /> property from east to e <br /> St. <br /> 3. the Board determined:tiat w.iho"ut relief the rp"' e could not be developed <br /> for which it was zoned(6mmercial use) wit ut ant of a variance. <br /> 4. the proposed lot cov 4rage is 5.3%. A/ <br /> 5. relief may be Z_ <br /> granted without detriment to the public good. <br /> 6. relief may be granted without derogating from the intent or purpose of the By- <br /> laws. <br /> For the foregoing reasons the Board determined that the applicant met the <br /> criteria necessary to grant a Variance, Upon motion duly made and seconded, the Board <br /> of Appeals voted unanimously on August 12, 1998 to grant the Variance. The permit is <br /> conditioned upon compliance with plans of Northside Design Associates dated May 28, <br /> 1998 and revised June 10, 1998. <br />
