Michaelson of Centerville, <br /> Massachusetts for a Variance under Section 174-31 of the Zoning By-laws for permission <br /> to vary the setback requirements to allow a 15.6 foot front setback and a 2 foot side <br /> setback for the construction of a garage on property located in an R-3 zoning district at 9 <br /> Fiddler Crab Lane (Map 105 Block 117) Mashpee, MA. (Owner of record: Christopher& <br /> Amy Tsiros.) <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in the Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on July 24 and July 31, 1998, a copy of <br /> which is attached hereto and made a part hereof . <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 12, 1998, at which time the following members of the Board of <br /> Appeals were present and acting throughout: James E. Regan IH, James M. Dorgan, and <br /> Robert G. Nelson. <br /> This decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Michael Groetzke of The Phoenix Group represented the applicant with a proposal <br /> to construct a 24 foot by 22 foot garage. He stated that the location of the garage was <br /> chosen next to a reserve area and a shared driveway in order to avoid impacting other <br /> neighbors or the septic system. He also stated that the proposed leeching reserve area is <br /> being relocated. <br /> Mi. Regan expressed concerns regarding the large size of the garage on the small <br /> lot and its close proximity to the property line and a reserve area.. He suggested that the <br /> Board members visit the site and that the applicant return to the Board with new plans to <br /> reduce the size of the garage. No comments were received from abutters. <br />
