Henshall V-98-120 24 Captains Row <br /> Map 90 Block 54 <br /> A Petition was filed on August 6, 1998 by Richard T. Henshall of Taunton, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the frontage setback and lot coverage requirements on property located in an R-3 <br /> zoning district at 24 Captains Row (Map 90 Block 54) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on September 4 and September 11, 1998, <br /> a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 23, 1998, at 7:30 P.M., at which time the following members of <br /> the Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Robert G. Nelson, <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape& Islands Engineering represented the applicant. He stated <br /> that the proposal is for the construction of a three-bedroom dwelling. Plans include <br /> removal of a cesspool and installation of a Title V septic system. The proposed project <br /> has received approval from the Conservation Commission. He informed the Board that <br /> the sloping topography of the lot affects the location of the construction and necessitates <br /> the request for a Variance of the frontage setback requirements. The applicant is also <br /> seeking a Variance of 1.6% of the lot coverage requirements. <br /> No comments were received from abutters. <br />
