Board of Appeals Thomas F. Smith SP-98-119 2
FINDINGS
General Finding
1. the subject property is located at 266 Monomoscoy Road and consists of
10,500 square feet.
Special Permit Criteria
Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General Law
Chapter 40A, Chapter 6, require a finding that the extension, alteration or change shall not
be substantially more detrimental to the neighborhood than the existing non-conforming
use.
Specific Finding
I. Mr. Smith failed to provide three sets of detailed plans of the garage along
with the original signature of the Registered Engineer.
2. the subject property fronts on Great River and Mr. Smith failed to provide
information on the impact of the project to the wetlands.
3. the Board denied Mr. Smith's request for a Variance as a result of Mr. Smith's
failure to receive approval of the location of the building from the
Conservation Commission.
In view of the foregoing, the Mashpee Board of Appeals found that the applicant
failed to meet the criteria necessary for the granting of a Special Permit. Upon motion
duly made and seconded, the Board of Appeals voted unanimously on October 14, 1998
to deny, without prejudice, Mr. Smith's request for a Special Permit.
