Cohen V-98-116 9 Chart Way <br /> Map 106 Block 17 <br /> A Petition was filed on August 19, 1998 by William J. Cohen of Mashpee, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the front setback and lot coverage requirements on property located in an R-3 <br /> zoning district at 9 Chart Way (Map 106 Block 17), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on September 4 and September 11, 1998, <br /> a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 23, 1998, at 7:30 P.M., at which time the following members of <br /> the Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan IH and Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Norman Hayes of the BSC Group represented the applicant. He stated that the <br /> applicant has received authorization from the Board of Health to move two existing <br /> cesspools on the property and install a new Title V septic system. The existing shed and <br /> patio will be removed. The Conservation Commission has approved construction of the <br /> addition and porch. Mr. Hayes informed the Board that since the coastal bank prevents <br /> any construction on that portion of the property, the project necessitates the request for a <br /> five-foot front setback variance on Chart Way. The applicant is also requesting a variance <br /> of 2% on lot coverage. No comments were received from abutters. <br />
