Vining et al, Trustee V-98-142 69 James Circle& 73 James Circle <br /> Map 64 Block 42 & Map 64 Block 41 <br /> A Petition was filed on October 2, 1998 by Michael P. Vining et al, Trustee, of <br /> Stoneham, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the front setback requirements to allow for construction of an addition <br /> and garage on property located in an R-5 zoning district located at 69 and 73 James <br /> Circle (Map 64 Block 42 and Map 64 Block 41),Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on October 9, 1998 and <br /> October 16,1998, a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 28, 1998, at which time the following members of the Board of <br /> Appeals were present and acting throughout: James E. Regan III,Robert G. Nelson and <br /> Richard T. Guerrera. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape& Islands Engineering represented the applicant who <br /> proposes to extend the existing house by sixteen feet and add a 26 foot by 24 foot garage. <br /> The sloping and narrow topography of the lot makes it necessary for the applicant to seek <br /> relief from the setback requirements. The project has also been submitted to the <br /> Conservation Commission. <br /> The Board moved to continue the hearing and requested that the applicant return <br /> with plans marked by a qualified individual indicating the location of the buffer zone and <br /> the wetlands. <br /> At the continued hearing on November 18, 1998,the following members of the <br /> Board of Appeals were present and acting throughout: James E. Regan, Robert G. <br /> Nelson and Richard T. Guerrera. <br /> John Slavinsky of Cape& Islands Engineering submitted a plan flagged by the <br /> firm of Sanford Ecological Service, Inc. indicating the location of the buffer zone and the <br /> wetlands. <br /> No comments were received from abutters. <br />
