Board of Appeals Mike's Service Station SP-98-147 2 <br /> FINDINGS <br /> General Finding <br /> 1. the subject property is located at 135 Main Street and consists of 42,420 <br /> square feet. <br /> Special Permit Criteria <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General Law <br /> Chapter 40A, Chapter 6, require a finding that the extension, alteration or change shall <br /> not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. <br /> Specific Findings <br /> I. the changes between the proposed replacement and the prior one will result in <br /> a slight increase in lot coverage, but it is under the allowable 20%. <br /> 2. while the proposed replacement will increase the non-conforming nature of <br /> the structure,the changes will not result in a structure or use which is more <br /> detrimental to the neighborhood than the prior non-conforming structure and <br /> its use. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Special Permit. Upon motion duly made <br /> and seconded, the Board of Appeals voted unanimously on November 18, 1998 to grant <br /> the Special Permit. The permit is conditioned upon the following: <br /> I. the lighting shall be recessed into the deck of the canopy so that it does not <br /> extend below the lip of the structure. <br /> 2. the lighting will be adjusted if complaints are received from neighbors, <br /> 3. compliance with plan entitled 'Troposed Gas Station Renovations Located in <br /> Mashpee—Mass., Prepared for S. Joseph DiMaggio, being Plan No. 082498, <br /> dated August 24, 1998". <br />
