V-98-143 2 Bright Coves Way
Map I I I Block 41
A Petition was filed on October 1, 1998 by Dunhill Development Companies,
Ltd. of Osterville,Massachusetts for a Variance from Section 174-31 of the Zoning
By-laws for permission to vary the frontage requirements on property located in an R-3
zoning district at 2 Bright Coves Way (Map I I I Block 41), Mashpee, MA. (Owner of
record: Alphonse A. and Donna 1. Bochanowski.)
Notice was duly given to abutters in accordance with Massachusetts General
Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a
newspaper of general circulation in the Town of Mashpee, on November 3, 1998 and
November 13,1998, a copy of which is attached hereto and made a part hereof
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, November 18, 1998, at which time the fa Ilowing members of the Board of
Appeals were present and acting throughout: James E. Regan 111, Robert G. Nelson and
Richard I Guerrera.
This Decision is issued by the Mashpee Board of Appeals pursuant to the
provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of
Mashpee Zoning By-laws.
Mr. Frank Ward represented the applicant stating that due to the "green belt" (a
reserved area), the property does not meet the minimum frontage requirement of 75 feet.
Mr. Ward said that the location of the proposed house and driveway were repositioned so
that the lot would not have access across the reserved area.
Building Commissioner William F. Hauck stated that the original plan did not
incorporate the subject lot, which now has to conform to the zoning by-laws.
Mr. Boyd, an abutter, expressed interest in the project to ensure the reserved area
is preserved. No other comments were received ftom abutters.
